  • Reckless Driving - This is a class of driving offenses that include extremely serious or aggressive behaviors on the road, such as tailgating, extreme speeding, cutting other drivers off, etc.
  • Drunk Driving - A person can be arrested for DUI if they test at or above the legal limit of .08 percent BAC (or any measurable alcohol if under 21 years old). Similarly, an individual can be arrested for refusing a chemical test after being stopped for suspicion of DUI.
  • Texting and Cell Phone Use - Distracted driving is one of the leading causes of avoidable injury and death in New York, so the state imposes very strict penalties for cell phone violations. This could include heavy fines and up to five points against your license.

When it comes to the treatment of traffic violations, no two insurance companies are the same. However, many providers may increase your rates for traffic-related convictions. In New York, drivers do have the opportunity to save up to ten percent on liability or collision premiums if they are ticketed. How Traffic Tickets Can Affect Your Driver's License

The state of New York DMV operates on a point system when it comes to driver's licenses. Each traffic violation warrants a different number of points against a person's license.

Listed below are some common traffic violations and how many points the DMV gives upon a conviction:

  • Speeding: 3 points
  • Speeding 11-20mph over limit: 4 points
  • Speeding 21-30mph over limit: 6 points
  • Speeding 31-40mph over limit: 8 points
  • Speeding 40+mph over limit: 11 points
  • Reckless Driving: 5 points
  • Cell Phone Use and Texting: 5 points
  • Failure to Yield: 3 points

It is important to remember that you are not obligated to pay your traffic ticket. Paying your traffic ticket is essentially an admission of guilt. You have the opportunity to contest your traffic ticket so that you are not ultimately convicted. If you are not convicted, the points won't go against your license. It is also important to note that the New York DMV does not count points against your license for violations outside the state (with the exception of violations in Ontario and Quebec).

Points against your driver's license accrue for 18 months. If the DMV applies 11 or more points against your record within an 18-month period, then they have the right to suspend your license. Contrary to DUI-specific DMV hearings, individuals cannot request a DMV hearing to contest their suspension for 11 points or more. The only exception would be DMV hearings to prove that it was not you who committed the traffic offense.
