New York City Cancellation of Removal

  • Whether you have been of good moral character per the definition of the Immigration and Nationality Act.
  • Your criminal record. Note that conviction for an aggravated felony bars you from eligibility for cancellation except in certain limited circumstances.
  • You or your child has battered or subjected to extreme cruelty by your United States citizen or LPR spouse.
  • Whether your removal would result in extreme hardship for you or certain members of your family.
  • You are not otherwise inadmissible and deserve a favorable exercise of discretion.
