The 5 Degrees of Criminal Arson Charges

In the state of New York, arson charges fall under 5 degrees. These different arson charges correspond to the level of seriousness of the crime.

  • 5th degree arson is a Class A misdemeanor and is usually handed out to individuals who did not intend to start a fire.
  • Arson in the 4th and 3rd degrees is considered a felony offense and entails that an individual intentionally set the fire. The type of property burned has a significant bearing on the seriousness of the offense. Burning down an unoccupied, non-residential building does not carry the same penalties as burning down an unoccupied, residential building.
  • If the crime involved burning down an occupied building, you could face 2nd or 1st degree arson charges. 1st and 2nd degree arson are considered Violent Felonies and carry much more serious consequences as they entail that you intended to cause bodily harm to another individual.
