The 5 Degrees of Criminal Arson Charges

In the state of New York, arson charges fall under 5 degrees. These different arson charges correspond to the level of seriousness of the crime.

  • 5th degree arson is a Class A misdemeanor and is usually handed out to individuals who did not intend to start a fire.
  • Arson in the 4th and 3rd degrees is considered a felony offense and entails that an individual intentionally set the fire. Burning down an unoccupied, non-residential building does not carry the same penalties as burning down an unoccupied, residential building.
