New York’s Adult Survivors Act: A Guide to Understanding and Using the Law

New York’s Adult Survivors Act (ASA) became effective on November 24, 2022, providing a one-year lookback window for survivors of sexual abuse to seek civil remedies regardless of the year the abuse occurred.

This law allows survivors to file a lawsuit against both their abusers and the institutions that enabled them. The one-year lookback window lasts until November 23, 2023, which means survivors have just over ten months to take advantage of the law.

The ASA creates an opportunity for survivors of sexual abuse to pursue civil claims in court, even for abuse that may have occurred years earlier, as long as they were over 18 at the time. Before the law, survivors had only a few years to file a lawsuit before their claim would be time-barred.

This meant that survivors had little time to prepare a case and file an action. For those who missed that small window, the ASA reopens the courthouse doors. So until November 23, 2023, whether you experienced abuse in 2015, 2000, or 1985, you can file a claim in court and seek recovery for what happened to you.
