Understanding Patent Prosecution Laws
Patent prosecution is the process of filing a patent and obtaining protection of that patent with the United States Patent and Trademark Office (USPTO). Patents are useful for a variety of industries, from technology to the pharmaceutical industry.
These are the steps involved in prosecution:
- 1.First Office Action - The patent examiner determines whether or not the patent is compliant with the legal requirements. Some portions or the patent may be rejected and in some cases, the entire application can may be as well.
- 2.Amendment and Response - The applicant may wish to consult with a New York patent lawyer to draft a response, if there are any disagreements or to raise concerns about errors made in the First Office Action.
- 3.Denial of patent application - Once the applicant has issued a response, it is at this point that the entire application is accepted. However, if the application is rejected in this second round of review, this is considered the “final rejection. The applicant may choose to appeal this decision, persuade the examiners to reconsider, or abandon the patent altogether.
