How to Apply for Asylum

On the application, they must demonstrate a genuine fear of future persecution if they returned to their homeland. Persecution entails various forms of mistreatment, including severe discrimination, violence, threats of harm, torture, harassment by law enforcement, detention, and confinement. You can establish asylum by proving you have been the victim of persecution prior to arriving in the U.S. or you are subject to future persecution.

Eligible individuals must apply for asylum within one year of entering the U.S. If the deadline has passed and there is a risk of deportation, they may apply for asylum and withholding or removal by completing Form I-589.
