How Does the Process Work?

Registering a trademark can be somewhat time-consuming, mostly due to the fact that the review portion. Many applications are under review at this time. Here is a breakdown of the trademark prosecution process:

  • 2.Opposition - Third parties may raise objections to your trademark if there is any indication that registering your trademark may hurt their properties, ideas, or invention.
  • 3.Cancellation - After five years, third parties may move to cancel registration for a variety of reasons. For example, they may make a claim that the trademark is deceptive and misleads potential consumers, generic, or the idea was abandoned.
  • 4.Maintenance - Ten years after filing for a trademark, the trademark will be due to expire. It must be renewed before the ten-year deadline.

The purpose of a trademark is to mark that intellectual property, invention, or product as unique from other types of products in the same category. It is useful to register a trademark that has a special appearance, sound, or function that is unlike similar items and also avoiding describing the goods. This sends a message to the general public that the item or idea carries a certain esteem or purpose that is distinct.
