What are considered to be deportable offenses?

Even after you have been lawfully admitted to the United States as a permanent resident, you may be deported as a result of committing certain crimes. Fight Deportation in New York

There are two major ways to stay in the U.S. after you receive notice of removal:

  • Present the argument in court that you are not removable as charged, OR
  • Petition for "relief from removal"

In order to be deported from this country, you must have committed a deportable offense. According to 8 USC § 1227, there are seven categories of deportable offenses. Those include:

  1. The alien was inadmissible at the time of their entrance to the U.S.
  2. They have been convicted of a criminal offense
  3. They failed to register their residency through the necessary routes and/or presented fraudulent immigration documents
  4. The alien presents a security threat to the United States
  5. The alien, within five years after entry to the U.S., has become a public charge
  6. The alien unlawfully voted
  7. Some domestic violence related incidents, unless the alien can be proven to have been the victim and not the primary perpetrator

If your removal order contains one or more of the aforementioned categories, you may be able to contest in court that these accusations are not accurate.
