Changes to New York Foreclosure Laws
New York State has one of the longest foreclosure timelines in the country, averaging about three years.. This was due to the fact that after the foreclosure action was filed, attorneys were not filing a mandatory affirmation right away. The mandatory affirmation is filed by the plaintiff’s attorney to certify that the plaintiff is in fact the creditor entitled to enforce their rights according to various loan documents.
It is now required for the foreclosure plaintiff’s attorney to file the mandatory affirmation along with the initial complaint, speeding up the process significantly. Once the mandatory affirmation and initial complaint have both been filed, an attorney may be able to help you come to a mutually agreeable way out of your foreclosure with your lender.
Steps After Receiving a Notice of Foreclosure
- If you have been served personally with a Summons and Complaint in foreclosure, you only have 20 days to respond. For those served by alternate methods, you have 30 days to respond to the notice.
- In either case, you have to file a Formal Answer, wherein you are required to respond to each allegation against you in the Summons and Complaint. This is also where you can assert your defenses.
- The Formal Answer will then have to be acknowledged by a Notary Public and served before the Court and opposing counsel.
