Nepal Designated for Temporary Protected Status

In response to the devastation caused by the recent 7.8 magnitude earthquake that struck Nepal in April of this year, the Department of Homeland Security has granted the country Temporary Protected Status (TPS) for the next 18 months. Any Nepalese nationals currently residing in the United States, or those without nationality who have habitually resided in Nepal, are now eligible to apply for TPS through USCIS.

Nepal’s TPS is valid until December 24, 2016. Any Nepalese nationals present in the United States who apply for and are granted TPS cannot be removed from the country during this period, and may be able to receive an Employment Authorization Document (EAD) that will grant them permission to work in the U.S.

What Are the Eligibility Requirements?

In order to be eligible, individuals must be able to prove that they have been continuously present and living in the United States since June 24, 2015. They must also undergo security checks to ensure that they do not pose any threats to national security.

To apply, applicants must fill out Form I-821. If an applicant is unable to pay the fees required along with their application, they may also request a fee waiver by filling out Form I-912 and providing supporting documentation.
